These Terms & Conditions govern the use of the website DeliveryBike.pl and the rental of bicycles provided by SilkRide Stanislav Hrim, Poland.
By making a reservation, signing a rental agreement, or using our services, you agree to these Terms & Conditions.

2. Service Description

The Company provides long-term bicycle rental services based on a subscription model.

The service is intended for:

  • food delivery couriers,

  • individual users for personal transportation or leisure,

  • companies (including restaurants and offices), subject to agreement.

The minimum age of the User is 18 years.
 

3. Registration & Platform Responsibility

  • Registration on the website is not required to make a reservation.

  • Online service functionality is provided via the Wix platform, which is responsible for technical service availability.

  • The Company is not responsible for temporary technical issues related to the platform provider.
     

4. Rental Types & Subscription

  • Available rental plans:

    • Weekly subscription

    • Monthly subscription

  • Subscriptions renew automatically as long as the bicycle is in use.

  • The User may cancel the subscription at any time via their account.

  • Cancellation takes effect at the end of the already paid period.

  • The User must notify the Company at least 7 calendar days in advance before returning the bicycle.

  • A rental agreement must be signed upon bicycle pickup.
     

5. Payments & Refunds

  • All prices are expressed in Polish Zloty (PLN).

  • Payment methods:

    • cash,

    • online payment.

  • Subscription fees are charged automatically according to the selected billing cycle.

  • Refunds, where applicable, are processed within 7 business days.
     

6. Security Deposit

  • A security deposit is required and paid 150 zlotys in cash upon bicycle pickup and contract signing.

  • The deposit is returned after the bicycle is returned and inspected.

  • The deposit may be partially or fully withheld in case of damage caused by the User.

  • If the deposit does not cover the damage, additional charges may apply.
     

7. Bicycle Use & Maintenance

  • The bicycle must be used only for its intended purpose.

  • The User is required to:

    • keep the bicycle clean,

    • regularly clean the frame and components,

    • maintain proper tire pressure and wheel condition,

    • immediately report any defects or malfunctions.

  • Unauthorized repairs or modifications are prohibited.
     

8. Return Condition, Risk & Liability

Return Condition

  • The bicycle must be returned clean and in good working condition, excluding normal wear.

  • If returned dirty, a 50 PLN cleaning fee will be deducted from the deposit.

  • If returned damaged or broken, repair costs will be calculated and deducted from the deposit or charged additionally.

Use at Own Risk

  • Bicycle use involves inherent risks.

  • The User uses the bicycle entirely at their own risk.

Limitation of Liability

  • The Company is not liable for personal injury, loss of income, or indirect damages, except where liability cannot be excluded by law.

  • Liability is limited to the maximum extent permitted under Polish and EU law.

User Safety Obligations

  • The User must:

    • comply with traffic regulations,

    • use safety equipment (e.g. helmet),

    • not operate the bicycle under the influence of alcohol or drugs.
       

9. Security & Theft

  • The bicycle must not be transferred to third parties without permission.

  • Leaving the bicycle unattended without proper security is prohibited.

  • In case of theft, the User must immediately notify the Company and the police.

  • Theft may constitute a criminal offense under Polish law.

  • Financial responsibility for loss caused by negligence remains with the User.
     

10. Force Majeure

Force Majeure Events

Force majeure includes events beyond reasonable control, such as:

  • natural disasters,

  • war or civil unrest,

  • government actions,

  • strikes,

  • epidemics or pandemics.

Procedure

  • The affected party must inform the other party promptly.

  • Obligations may be suspended for the duration of the force majeure.

  • If prolonged, the agreement may be terminated, subject to bicycle return.
     

11. Personal Data

  • Personal data is processed solely to provide the rental service.

  • Details are described in the Privacy Policy available on the website.

  • Data processing complies with GDPR and Polish data protection laws.

  • Users have rights to access, correction, and deletion of their data.
     

12. Governing Law & Jurisdiction

  • These Terms & Conditions are governed by the laws of the Republic of Poland.

  • Any disputes shall be resolved by the competent courts of Poland.
     

13. Changes to Terms & Conditions

  • The Company reserves the right to modify these Terms & Conditions.

  • Users will be notified of changes via SMS sent to the provided phone number.

  • Continued use of the service constitutes acceptance of updated terms.
